Welcome to Aukaat (the “App”, “Platform”, “Service”), operated by ZeboLive Pvt Ltd (“we”, “us”, “our”, the “Company”). These Terms & Conditions (“Terms”) govern your access to and use of Aukaat. By creating an account, accessing, or using Aukaat, you agree to be bound by these Terms. If you do not agree, do not use the App.
Age requirement: Aukaat is intended only for users aged 18 years and above. By using the App you confirm that you are at least 18 years old. We do not knowingly permit anyone under 18 to use the Service, make purchases, or interact with other users.
1. Definitions
“User”, “you” — any person who accesses or uses Aukaat.
“Creator”/“Host” — a User who broadcasts live content or offers content/interactions on the Platform.
“Coins” — virtual, in-app credits with no monetary value outside the App, used to access certain features, send virtual gifts, or unlock content.
“Content” — any text, image, video, audio, livestream, message, or other material made available on the App.
2. Eligibility & Account
You must be 18+ and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
You are responsible for maintaining the confidentiality of your account and for all activity under it.
You agree to provide accurate information and to keep it updated. One person may not maintain multiple accounts to abuse rewards, referrals, or promotions.
We may suspend or terminate accounts that violate these Terms, applicable law, or our community standards.
3. The Service
Aukaat is a social entertainment platform that may include live streaming, social feeds, messaging and calls, social discovery/connections, AI-powered content features, games, challenges, virtual gifting, and a virtual-coin economy. Features may change, be added, or be removed at any time.
4. Virtual Coins & Purchases
Coins are a virtual, limited, non-transferable license to access features within the App. Coins are not money, not a bank deposit, not e-money, and have no cash value outside the App.
Coins purchased with real money are non-refundable once credited, except where required by law. See our Refund & Cancellation Policy.
Free or bonus Coins (from rewards, referrals, daily activities, or promotions) may carry additional restrictions and are generally not withdrawable or convertible to cash.
We may modify Coin pricing, packages, and the features Coins unlock at any time. Prices are inclusive of applicable taxes unless stated otherwise.
Payments are processed by third-party payment gateways. We do not store your full card or banking credentials.
5. Creator Earnings & Payouts
Eligible Creators may earn in-app value (e.g., “beans”) from virtual gifts and may request payouts subject to our payout policy, minimum thresholds, identity/KYC verification, and applicable taxes (including TDS where required).
We may withhold or reverse earnings obtained through fraud, collusion, chargebacks, or violation of these Terms.
6. User Conduct
You agree not to:
Post or transmit content that is unlawful, obscene, sexually explicit, harassing, defamatory, hateful, violent, or that exploits or endangers any person;
Impersonate others, share another person’s private information, or solicit personal contact details for off-platform contact;
Use the App for fraud, money laundering, gambling not permitted by law, or any illegal activity;
Attempt to manipulate coins, rewards, referrals, votes, rankings, or payouts;
Upload malware, scrape the Service, or interfere with its operation;
Use another person’s likeness or generate AI content of real persons without consent.
Zero tolerance: Any sexual content involving minors, non-consensual content, or content that facilitates harm to others is strictly prohibited and will be reported to authorities where required.
7. AI Features
Aukaat may offer AI-generated images or other AI features. You may only generate AI content of yourself or of subjects you have the right to use. You must not use AI features to create misleading, deceptive, defamatory, or sexual content, or content depicting real individuals without their consent. AI output may be imperfect; it is provided “as is”.
8. Content & Licenses
You retain ownership of content you create, but you grant ZeboLive Pvt Ltd a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content for the purpose of operating and promoting the Service.
You are solely responsible for content you post and confirm you have all necessary rights to it.
We may remove content or restrict accounts at our discretion to enforce these Terms or the law.
9. Moderation & Reporting
We use a combination of automated filters, human review, and user reports to moderate content. You can report content or users in-app. We may remove content, issue warnings, or suspend/terminate accounts. We cooperate with law enforcement and comply with the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including appointment of a Grievance Officer (see Contact Us).
10. Disclaimers & Limitation of Liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind.
To the maximum extent permitted by law, ZeboLive Pvt Ltd is not liable for indirect, incidental, special, or consequential damages, or for user-to-user interactions or user-generated content.
Our total aggregate liability for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.
11. Indemnity
You agree to indemnify and hold harmless ZeboLive Pvt Ltd, its directors, employees, and partners from any claim arising out of your use of the Service, your content, or your breach of these Terms.
12. Suspension & Termination
We may suspend or terminate your access at any time for violation of these Terms or applicable law. Upon termination, unused Coins are forfeited to the extent permitted by law.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Continued use after changes constitutes acceptance. The “Last updated” date reflects the latest version.
